Kirkland prosecutor files appeal in Hope Solo case

Solo’s attorney had previously filed a motion to dismiss the charges, requesting two counts of fourth degree assault be dropped and claiming he has not been able to interview the alleged victims. City of Kirkland Prosecuting Attorney Tammy McElyea said depositions with the witnesses ultimately took place before the judge dismissed the charges, which stemmed from an altercation with Solo’s half sister and 17-year-old nephew during a party at a family home in Kirkland June 21.

McElyea said the city disagrees with the judge’s decision, which she said was not based on the facts of the case but technicalities and subjectivity.

“We take domestic violence in this town seriously,” she said.

McElyea said legal briefs for the appeal are due in July, with oral arguments expected to take place in September. If the King County Superior Court decides to uphold the appeal, the case will go back to Kirkland Municipal Court and through the process of setting a trial date.

Kirkland police responded to the June incident after receiving a call at around 1 a.m. by a man stating a female at the residence was “hitting people” and they could not get her to stop or to leave the house.

When officers entered the home they noticed Solo was upset and intoxicated, according to police documents. They also observed visible injuries to Solo’s nephew and her sister. Solo’s nephew had visible scratch marks, was bleeding from his ear and his t-shirt was torn, according to court documents.

Despite having the charges dismissed, a week later Solo was suspended from the U.S. Women’s Soccer team for a month after her husband and ex-NFL player Jerramy Stevens was arrested for driving under the influence in Manhattan Beach, Calif. Solo, who was in the vehicle with Stevens and attending a national soccer training camp, wasn’t arrested. She was reportedly drunk and belligerent with police, however, and Stevens was also alleged to have been driving a U.S. Soccer official team van at the time of his arrest.
