A Bellevue man has filed a complaint against a Kirkland Toyota car dealership, claiming he was fired through a text message after complaining about alleged racist remarks by one of the managers.
The man, who is Indian, has also filed a class action suit for being denied what he believed should have been a larger commission than he was paid under his employment contract.
According to the lawsuit, the man was hired by Toyota of Kirkland in 2012. He was allegedly one of their top salesmen for several months and received positive employee evaluations throughout his employment. He was also never disciplined in any way, the lawsuit claims.
In July 2014, a new sales manager was hired, who the victim claims diverted commissions from his sales to other employees who were not Indian. The sales manager also allegedly made racist remarks about Indians in front of him as well as Indian customers. At one point, the lawsuit alleges the alleged victim was told he “belongs working at a 7/11 and not in a car dealership.”
The lawsuit also alleges the sales manager made racially charged comments to the man in August after he had complained that non-Indian salespeople were being given credit for sales he had closed. The alleged victim then brought the matter up with the general sales manager, asking to be transferred to the Renton Toyota or Seattle Acura dealerships. He was later informed the same day he had been fired.
The lawsuit claims that no action was taken to address the alleged victim’s complaints.
The class action suit alleges that he was deprived of wages due to incorrect calculation of sales profits.
Calls to Toyota of Kirkland seeking comment were not returned.
