Sex offender charged in Kirkland Transit Center indecency case

King County Prosecutors charged a level three sex offender with felony indecency charges April 24 relating to two girls at the Kirkland Transit Center.

Kirkland Police say Kevin B. Wagner allegedly approached two teenage girls for sex there on Jan. 7. Prosecutors charged Wagner, whose last known address is in Seattle, with felony communication with a minor for immoral purposes on Friday at Superior Court and requested he be held on $50,000 bail.

According to an April 29 story in the Seattle Post-Intelligencer, the two 15-year old girls later identified Wagner, 53, from a photo montage. He was allegedly tracking the girls and other women he came into contact with on 3-by-5 note cards.

Wagner was originally listed as a sex offender in 2004 after he was convicted of third-degree rape, according to the King County Sheriff’s Office sex offender registry.

The new charges come while Wagner remains in county jail on a February assault conviction from another Kirkland-related incident.

According to records originally obtained for a Feb. 18 Kirkland Reporter police blotter entry, Wagner was drunk and riding a Metro Transit bus Feb. 4 when he began harassing two pre-teen girls and displaying pornographic materials.

Kirkland Police spokesperson Sgt. Rob Saloum said the incident started on the bus and continued off it.

“Evidently, Wagner was following two girls and they moved away from him,” he said. “They sought a couple out to sit near them and at some point one of the citizens had contact with him.”

He and two other male passengers exited the bus at 15th Avenue and Market Street and a physical confrontation ensued. Wagner later admitted to assaulting a 70-year-old man and threatening another juvenile male and plead guilty to fourth-degree assault.

“Obviously he has a history,” Saloum said. “Our main concern is welfare of the children and making sure they’re safe.”

A sex offender registry Website identifies Wagner as non-compliant and Sheriff’s spokesman Sgt. John Urquhart confirmed Wagner is currently listed as homeless.

Wagner’s arraignment is set in Seattle for May 7.
